Yes, in many cases.   In 2005, President Bush signed into law The Bankruptcy Abuse Prevention and Consumer Protection Act.  This new law represents one of the most comprehensive overhauls of the Bankruptcy Code in 25 years, particularly with respect to consumer bankruptcy reforms.  Nevertheless, even under the new law, it is entirely possible for many if not most people seeking bankruptcy protection to successfully and legally obtain debt relief.  The Law Firm of Michael A. Koplen has successfully represented hundreds of bankruptcy clients over the years.  We use the latest bankruptcy law software to ensure that the client gets the full debt relief available under the law.  Our computer system is linked directly to the Bankruptcy Courts and we file all petitions electronically.

The laws of New York State view your marriage as a financial partnership.   The law is complex, and there are many factors that will go into any final resolution of a divorce matter.  The law requires that upon divorce you are entitled to the full value of your contribution to the marriage.  This is called “equitable distribution.”  For child custody matters, the Court will consider the “best interests of the child” in making any determination.  Of course, it is often possible for divorcing couples to work out the terms of their divorce amicably, and the Court will usually approve of these types of settlements.  When such an amicable resolution is not possible, however, the Law Offices of Michael A.
